ETERNO Website Terms and Conditions

1. General
1.1. The website eternoscents.com (the “Website”) operates as an online store through which users in Israel and abroad may purchase products offered by ETERNO (the “Sales”).
1.2. These Terms and Conditions apply to every use of the Website and to every purchase made through it. They form the legal basis governing the relationship between you and ETERNO. Please read them carefully and in full.
1.3. Browsing the Website and/or purchasing products offered on it constitutes your agreement to these Terms and Conditions. A person who does not agree to any of these terms must refrain from using the Website.
1.4. Content uploaded and publicly displayed on the Website may also be displayed through other media, whether managed by ETERNO or otherwise, and may be used for any other lawful purpose. These Terms and Conditions shall apply to such display and use.
1.5. Words used in the singular include the plural and vice versa, and references to one gender include all genders, where the context permits.
1.6. Section headings are provided for convenience only and shall not affect the interpretation of these Terms and Conditions.
2. About the Sales
2.1. ETERNO enables customers to purchase its products through the Website in a convenient, quick and simple manner.
2.2. Each product offered for sale is accompanied by basic information, which may include the product name, quantity or volume, description, consumer price, payment terms and other relevant details (the “Product Page”).
2.3. All prices displayed on the Website include VAT where VAT is legally applicable.
2.4. After an order has been approved by the Website’s system and an order confirmation number has been issued, the user shall be considered the customer who placed the order. Customers must provide complete and accurate information. ETERNO cannot guarantee successful processing or delivery where incorrect or incomplete information has been supplied.
2.5. Following submission of an order, the Website and/or the applicable payment provider will verify the payment details. Once the transaction is approved, the order will be recorded and an order confirmation will be sent by email. Only an email confirmation containing the relevant order details shall constitute confirmation that the order was received by ETERNO. ETERNO’s computerized records shall serve as prima facie evidence of the transaction.
2.6. If the transaction is not approved by the payment provider, the customer will receive an appropriate notice and may be required to contact customer service to complete payment authorization. The order will be considered complete only once authorization has been obtained. Delivery times will be calculated from the date of authorization. If authorization is not arranged within seven days after notice of refusal, ETERNO may cancel the order.
2.7. Products displayed on the Website are generally offered subject to availability. If a purchased product is unavailable, ETERNO may notify the customer by email or telephone and may offer an equivalent substitute. The customer may accept the substitute or cancel the order. If the order is cancelled, ETERNO will not charge the customer or will refund any amount already paid for the unavailable product.
3. Online Sales
3.1. An online sale is a sale of products at a predetermined price, while supplies last.
3.2. The customer selects the desired product and completes the purchase in accordance with the instructions on the Website. Customers are encouraged to review the Product Page before purchasing.
3.3. Products may be ordered online 24 hours a day, 365 days a year, subject to availability and Website operation.
3.4. Sales through the Website are intended for end consumers only and not for wholesalers or retailers, unless ETERNO agrees otherwise in writing.
4. Supply, Delivery and Collection
4.1. ETERNO will arrange delivery of products purchased through the Website to the address in Israel entered by the customer, within the delivery period stated on the relevant Product Page, unless otherwise indicated.
4.2. ETERNO will supply only products that have been paid for in full and are available in stock.
4.3. ETERNO makes reasonable efforts to update the Website when products are unavailable. Nevertheless, an out-of-stock product may occasionally appear as available. Subject to applicable law, ETERNO shall not be liable for indirect loss resulting from non-supply of an unavailable product.
4.4. For locations subject to access or security restrictions, ETERNO may coordinate delivery to a nearby accepted collection point. Delivery to such areas may be delayed by up to 14 additional days, and such delay shall not be considered a breach where caused by the access restriction.
4.5. Standard delivery charges do not include exceptional delivery requirements or international shipping. ETERNO may charge an additional amount for exceptional or international delivery, as communicated to the customer before completion of the order.
4.6. Deliveries are subject to the procedures of the courier company selected by ETERNO. Delivery may be made to the customer’s address or to another location determined by the courier company. In community villages, kibbutzim and similar locations, delivery may be made to a local postal point, community office or another customary collection location.
4.7. Delivery periods are calculated in business days, Sunday through Thursday, excluding Fridays, Saturdays, public holidays and holiday eves.
4.8. Delivery charges may be paid separately or together with the product price. Where payment is divided into installments, ETERNO may charge the delivery fee with the first payment.
4.9. Where self-collection is available, the customer may collect the order from ETERNO at 2 Raoul Wallenberg Street, Ramat HaHayal, Tel Aviv 6971901, during the applicable collection hours and only after receiving confirmation that the order is ready. The order must be collected within 14 business days from the date of order confirmation. Failure to collect within this period may be treated as a cancellation, subject to applicable cancellation fees under Israeli law.
4.10. For fraud-prevention and verification purposes, ETERNO and/or the courier may require the cardholder to be present at delivery, present identification and/or sign a delivery confirmation.
4.11. Where a product requires registration by law, the registration will be made in the name of the customer and according to the information provided when ordering.
4.12. Unless otherwise stated on the Product Page, deliveries by courier are generally made within four business days, while items sent by registered mail may take up to 14 business days. These periods do not apply to restricted-access areas.
4.13. Any free-shipping threshold and delivery fee displayed during checkout shall apply to the order. In the event of a conflict, the amount displayed and approved at checkout will prevail.
5. Exchanges, Returns, Refunds and Store Credit
5.1. A request to exchange or return a product must be submitted within 14 days from the date of purchase and must be accompanied by an exchange receipt, tax invoice or other legally valid proof of purchase showing the purchase date.
5.2. Store credit may be issued upon presentation of valid proof of purchase. The credit amount will reflect the amount actually paid. Unless otherwise required by law, a store-credit voucher will be valid for 12 months from its date of issue.
5.3. A monetary refund may be issued upon presentation of a tax invoice, provided that the product is unopened, unused, undamaged and remains in its original packaging, and subject to the requirements and exceptions prescribed by applicable law.
5.4. Where legally permitted, cancellation fees may be charged in an amount of up to 5% of the transaction price or NIS 100, whichever is lower. If a payment provider charged ETERNO a non-refundable processing fee in connection with the cancelled transaction, ETERNO may charge that fee to the customer where permitted by law.
5.5. A product purchased through the Website may be exchanged or returned at ETERNO’s collection location at 2 Raoul Wallenberg Street, Ramat HaHayal, Tel Aviv 6971901, during the applicable opening hours and subject to prior coordination. Alternatively, a return or exchange may be arranged by courier. The applicable courier charge will be communicated to the customer before collection. An exchange may require two separate deliveries.
6. Customer Service
6.1. For questions regarding products displayed on the Website, including product specifications, instructions for use, ingredients, care information or other matters related to products purchased through the Website, customers may contact ETERNO customer service.
6.2. Customer service contact details shall be those displayed on the Website’s Contact page. ETERNO will make reasonable efforts to respond within 24 hours on business days, Sunday through Thursday.
7. Eligibility to Use the Website
7.1. A user may purchase products through the Website subject to all of the following conditions:
7.1.1. The user is legally competent to enter into binding transactions. A minor or any person requiring guardian approval may use the Website only with such approval.
7.1.2. The user holds valid identification and provides any information reasonably required by ETERNO or its payment provider for verification and legal compliance.
7.1.3. The user has a valid payment method accepted by the Website, an active email address and a delivery address supported by ETERNO. Customers requesting delivery outside Israel must contact ETERNO in advance and will be subject to ETERNO’s international delivery terms.
7.2. Without limiting any other right, ETERNO may prevent a user from using the Website or participating in Sales where:
7.2.1. the user has committed an unlawful act or breached applicable law;
7.2.2. the user has breached these Terms and Conditions;
7.2.3. the user intentionally provided false or misleading information;
7.2.4. the user committed an act or omission that may harm ETERNO, its representatives, the proper operation of the Website or any third party; or
7.2.5. ETERNO reasonably believes that the user intends to resell or commercially trade products purchased through the Website without authorization.
8. Privacy
8.1. To complete a purchase, customers may be required to provide information such as name, address, email address, telephone number and payment information. Payment details may be processed directly by third-party payment providers.
8.2. Information provided to ETERNO during registration, purchase or use of the Website, together with information collected during browsing, may be stored and processed in ETERNO’s databases in accordance with applicable law and ETERNO’s Privacy Policy.
8.3. ETERNO will not use personal information without authorization except where necessary to provide the service, comply with law, prevent misuse, protect legal rights or as otherwise permitted under the Privacy Policy. Access will be limited to persons who require the information for legitimate business purposes.
8.4. ETERNO uses reasonable and customary safeguards to protect personal information. Payment-card information transmitted through the Website is processed using accepted security standards. Nevertheless, no system is completely secure, and ETERNO shall not be liable for events outside its reasonable control, subject to applicable law.
8.5. During registration or checkout, users may be offered the option to join ETERNO’s mailing list and receive promotional emails and/or SMS messages. Joining is optional, and users may unsubscribe at any time using the unsubscribe option included in communications or by contacting ETERNO.
8.6. ETERNO may use aggregated and anonymized information for statistical analysis, service improvement, traffic measurement, purchasing-pattern analysis and similar legitimate business purposes, provided that the information does not personally identify the user.
8.7. The Website may use cookies and similar technologies to provide efficient service, remember preferences, analyze use and improve the browsing experience. Users may adjust browser settings to block or delete cookies, although doing so may affect Website functionality.
9. Cancellation of Transactions
9.1. A customer may cancel a transaction in accordance with the Israeli Consumer Protection Law, 5741-1981, and the regulations enacted under it.
9.2. For a product purchase, the cancellation period generally runs from the date of the transaction until 14 days after the customer receives the product or receives the legally required transaction document, whichever is later, subject to statutory exceptions.
9.3. Where the customer is a person with a disability, a senior citizen or a new immigrant, and the transaction included a conversation with the business, including through electronic communication, the statutory cancellation period may be extended to four months, subject to the requirements of applicable law.
9.4. ETERNO may request documentation permitted by law to verify eligibility for an extended cancellation period and will not require additional proof beyond what the law allows.
9.5. A cancellation request must be submitted in writing through the cancellation method or customer-service contact details displayed on the Website. The request should include the customer’s full name, telephone number, contact details and order information. Physical correspondence and eligible returns may be sent or delivered, subject to prior coordination, to ETERNO, 2 Raoul Wallenberg Street, Ramat HaHayal, Tel Aviv 6971901.
9.6. Cancellation due to defect, non-conformity, failure to supply within the agreed period or another material breach will be handled in accordance with applicable law. Where required, ETERNO will refund the amount paid, cancel the charge, provide confirmation of cancellation and will not charge a cancellation fee. If the customer received the product, it must be returned in accordance with ETERNO’s instructions.
9.7. Where cancellation is not due to a defect or non-conformity, ETERNO may charge a cancellation fee of up to 5% of the product price or NIS 100, whichever is lower, as permitted by law. Original delivery fees may be non-refundable where permitted by law. The product must be returned unopened, unused, undamaged and in its original packaging, except where the law provides otherwise.
9.8. Where a returned product has materially deteriorated while in the customer’s possession, including through damage, breakage, spoilage, misuse, altered appearance or damaged packaging, ETERNO may exercise any remedy available under law, including claiming compensation for proven damage. Customers are encouraged to return products complete and in their original packaging.
9.9. Cancellation rights do not apply to products and services excluded under Section 14C(d) of the Israeli Consumer Protection Law or any other applicable statutory exclusion.
9.10. ETERNO may cancel an order or sale, in whole or in part, where:
9.10.1. an obvious and exceptional clerical error appears in the price or product description;
9.10.2. force majeure, war, hostilities, terrorism, governmental restrictions or another event outside ETERNO’s reasonable control prevents proper completion of the sale;
9.10.3. the transaction involved unlawful activity by the customer or a third party; or
9.10.4. ETERNO reasonably believes the customer intends to resell or commercially trade the product without authorization.
9.11. Notice of cancellation may be provided by telephone, email or another contact method supplied by the customer. In such a case, the order will be cancelled and any amount already paid will be refunded, subject to applicable law. Except for the refund due, the customer will have no claim arising solely from such cancellation, unless the law provides otherwise.
10. Liability
10.1. Product Liability
10.1.1. ETERNO enables customers to purchase its products through the Website in a convenient, quick and simple manner.
10.1.2. An obvious clerical error in a product or service description will not bind ETERNO. Product images are for illustration only, and differences may exist between the images displayed and the products actually supplied.
10.1.3. Subject to applicable law, ETERNO and anyone acting on its behalf shall be liable only for direct and proven damage caused by their breach or negligence and shall not be liable for indirect, consequential or special damage, including loss of income or profit.
10.1.4. ETERNO shall not be responsible for delays or non-delivery caused by force majeure or events outside its reasonable control, including strikes, shutdowns, security events, transportation disruptions and similar circumstances.
10.1.5. To the fullest extent permitted by law, ETERNO shall not be liable for indirect, consequential or special damage resulting from delay, disruption or failure in the supply of a product or service.
10.1.6. ETERNO’s liability for defective products shall be governed by the Israeli Defective Products Liability Law, 5740-1980, and any other applicable law.
10.2. Website Liability
10.2.1. The Website and its services are provided on an “AS IS” and “AS AVAILABLE” basis. Subject to applicable law, users shall have no claim regarding features, limitations or suitability for their particular needs.
10.2.2. ETERNO makes reasonable efforts to maintain proper Website operation but does not guarantee uninterrupted or error-free service. ETERNO shall not be liable for failures in hardware, software, internet infrastructure, telecommunications systems or other systems outside its reasonable control.
10.2.3. ETERNO is not responsible for unlawful activity conducted by users or for actions of third parties outside its reasonable control.
10.2.4. ETERNO is not responsible for content published on third-party websites linked from the Website and does not guarantee that any external link will remain active or accurate.
11. Additional Terms
11.1. All information and content displayed on the Website, including graphics, design, text, icons, trademarks, logos, photographs, product names, layouts and their presentation, are owned by ETERNO and/or its licensors. They may not be copied, reproduced, distributed, published or otherwise used without ETERNO’s prior written consent.
11.2. The display of a product on the Website does not constitute a professional opinion or representation beyond the express product description.
11.3. ETERNO’s computerized records regarding actions performed through the Website shall serve as prima facie evidence of those actions.
12. Governing Law and Miscellaneous
12.1. These Terms and Conditions and any action or dispute arising from them shall be governed by the laws of the State of Israel. Jurisdiction shall lie with the competent courts in the Tel Aviv District, subject to any mandatory jurisdiction rules.
12.2. ETERNO may update these Terms and Conditions from time to time at its discretion, subject to applicable law. The version published on the Website at the relevant time shall be the binding version.
13. General Disclaimer
13.1. ETERNO and anyone acting on its behalf shall not be liable for direct or indirect damage resulting from reliance on general information displayed on the Website where such information does not constitute professional advice. Any general content provided through the Website is for informational purposes only, and responsibility for its use rests with the user, subject to applicable law.
14. Store Collection Policy
14.1. Orders placed through the Website or directly with ETERNO will be held for self-collection for up to 14 business days from the order date or from the date the customer is notified that the order is ready, as applicable.
14.2. If the order is not collected within this period, ETERNO may move it to another storage location. The customer will be responsible for coordinating and completing collection.
14.3. Cancellation and refund rights remain subject to the Israeli Consumer Protection Law, including the applicable 14-day period and the requirement that the product has not been damaged or used, except where the law provides otherwise.
14.4. After the statutory cancellation period has expired, no refund or compensation will be available unless required by law or expressly approved by ETERNO.
14.5. The customer is responsible for collecting the order and notifying ETERNO of any delay. Subject to applicable law, ETERNO is not responsible for items left uncollected beyond the periods stated above.
